Switzerland Circuit Court.

State vs. Albert Brindley; assault and battery. Plea guilty, fined $1.

Sarah F. Brownfield vs. John W. Neal et al; partition of real estate—Land sold by Commissioner and distribution ordered.

William Hall, Executor of the estate of Joshua Smithson, deceased, and administrator of the estate of Sarah Smithson, deceased, vs. Eugene W. Smithson, deceased, vs. Eugene W. Smithson et al; to construe two wills, &c. Mr. Hall as Commissioner reported sale of a portion of real estate, and resigned as such Commissioner. Geo. S. Pleasants appointed Commissioner to sell remainder of real estate.

Robert B. Henry vs. James M. Scott, Trustee; to have an accounting. Tried before Chas. E. Walker, special Judge. Judgment for defendant.

Elvira Murret et al vs. David Huston et al; partition of real estate. Commissioner reported sale and deed was approved.

State vs. Tobe Still; assault and battery. Plea guilty, fined $1.

State vs. Samuel Gilbert; assault and battery. Tried by Court, not guilty.

David Brownfield vs. John W. Neal; to quiet title. Dismissed by plaintiff at his cost.

State ex rel D. N. Haydon, Auditor, vs. John L. Smith et al; foreclosure—Dismissed by plaintiff, costs paid by defendant.

Cynthania K. Scranton vs. Jason G. Gurley; on note. Judgment for $200 by agreement.

State ex rel D. N. Haydon, Auditor, vs. Stephen Ricketts et al; foreclosure. Judgment for $834.84 and 2 percent damages and foreclosure.

State vs. Stephen Spears; selling intoxicating liquors without license, five cases. Plea of guilty in two, fined $5 and costs each case, three cases nollied.

State vs. Samuel Fallis, assault and battery with intent. Jury fined him guilty of assault and battery, fined him $100 and imprisonment in county jail for four months.

The Grand Jury returned 25 indictments.

The will and codicil of Margaret Rutherford, deceased, approved and admitted to probate and record.

Petition of William Geiske, Guardian of David C. Hageman et al. Conveyance of real estate ordered and deed approved.

John Pattie was appointed Guardian of Madge Pattie et al. Petition to sell real estate granted, sale ordered and deed approved.

George Kelleher was appointed guardian of Kate Kelleher, insane.

William R. Protsman, Administrator of Polly Protsman, deceased. Partial report approved.

Claims allowed against the estate of Julia H. McCormick, deceased: Dr. John W. Smith, $205. Anna B. Schroder, $75.

State vs. William Rook—selling liquor without license. Plea of guilty, two cases, fined $5 and costs each.

State vs. Silas Silvers—selling liquor without license. Plea of guilty, one case, fined $5 and costs.

State vs. John Schaffer—larceny.—Found guilty and, being a minor, committed to the Indiana Reform School for Boys until 21, or legally discharged.

Frederick W. Housemeier vs. Isaac Richards—to revive judgment. Finding for plaintiff.

David Lostutter vs. William D. Wallick—on note. Dismissed at cost of defendant.

State vs. Thomas Heady—assault and battery. Plea of guilty, fined $1 and costs.

State vs. Irven Montayne—assault and battery with intent, etc. Trial by Jury. Found guilty of assault and battery; fined $5 without costs.

Harriet Cotton et al vs. William H. Manuel—partition of real estate. Sale ordered.

Elvira Muret et al vs. David Huston et al—partition of real estate. Distribution ordered.

Re-appraisement ordered of the real estate belonging to the estates of Joshua and Sarah Smithson, deceased.

State vs. Wm. Told—provoke. Plea of guilty; fined $1 and costs.

John T. Ellis allowed $50 for defending Smith Roberts.

Jane A. Gibson vs. Adolphus E. Merit et al—motion for the appointment of a receiver. Receiver appointed. Appealed to the Supreme Court.
